Foreclosure defense is litigation, not paperwork. The firm defends foreclosure and mortgage-related matters at the trial level and on appeal, with attention to pleadings, evidence, procedure, statutes, judgment issues, sale-confirmation issues, and the preservation of issues for appeal.
A litigation-focused approach
Many foreclosure matters are treated as routine paperwork. They are not. A foreclosure case is a civil lawsuit, and it can be won or lost on the pleadings, the evidence, the procedure, and the law. Jim evaluates foreclosure and mortgage matters the way any other serious litigation is evaluated: what must the lender prove, where is the exposure, what defenses and procedural issues are available, and how should the matter be positioned for trial and, if necessary, appeal.
The firm represents property owners, borrowers, homeowners, land trusts, and business owners in foreclosure and mortgage-related matters.

Experience
Trial, appellate, and Illinois Supreme Court experience
Jim's foreclosure and mortgage litigation work includes trial-level and appellate matters, including matters before the Illinois Supreme Court. He served as counsel for the appellees in First Midwest Bank v. Cobo, 2018 IL 123038, an Illinois Supreme Court decision addressing foreclosure-related litigation and the application of Illinois' single-refiling rule under section 13-217 of the Code of Civil Procedure.
He also serves as counsel for the petitioner-appellant in a matter currently pending before the Illinois Supreme Court, Chicago Title Land Trust Co. v. Watkin, No. 132383, which arises from the First District decision reported at 2025 IL App (1st) 241354 and involves mortgage and real estate issues. That matter has not been decided.
